Performance Product Notice

Performance parts, engine modifications, and custom tuning may significantly increase vehicle horsepower, torque, speed, and overall performance. These modifications may also increase stress on engine, drivetrain, and other vehicle components.

Vehicles modified for performance use may behave differently than stock vehicles and may require additional maintenance or inspection.

Nelson Performance recommends that performance-modified vehicles be operated responsibly and by experienced drivers.

Off-Road / Competition Use

Many performance parts and tuning calibrations offered by Nelson Performance are intended for off-road or competition use only.

These products may not comply with federal, state, or local emissions regulations. It is the customer’s responsibility to ensure compliance with all applicable laws in their jurisdiction.

Nelson Performance assumes no responsibility for the legality of vehicle modifications requested by customers.

Customer Responsibility

By authorizing work or purchasing services from Nelson Performance, the customer acknowledges and agrees that:

Vehicle modifications are performed at the customer’s request.
Performance modifications may reduce the lifespan of certain vehicle components.
Increased engine output places additional stress on engine, drivetrain, and other systems.
Mechanical failures of related components may occur before, during, or after modifications.

The customer assumes all risks associated with the installation and use of performance parts and custom calibrations.

Tuning Disclaimer

Custom engine and transmission calibrations are developed based on available vehicle data, configuration, and testing conditions.

Because every vehicle is unique and operating conditions vary, Nelson Performance cannot guarantee specific horsepower gains, fuel economy improvements, drivability characteristics, or mechanical reliability.

All tuning services and calibration files are provided as-is.

No warranty, express or implied, is provided on tuning services, calibration files, or tuning adjustments.

Release of Liability

By purchasing services or products from Nelson Performance, the customer agrees that Nelson Performance LLC, including its owners, employees, contractors, and affiliates, shall not be held liable for any damages, claims, losses, or expenses resulting from:

Vehicle modifications
Custom tuning
Installation of performance components
Mechanical failure of vehicle components
Use or misuse of performance products

This includes but is not limited to:

Engine failure
Transmission damage
Drivetrain damage
Loss of vehicle use
Property damage
Personal injury

Limitation of Liability

Nelson Performance shall not be liable for indirect, incidental, special, or consequential damages including but not limited to:

Labor costs
Towing expenses
Rental vehicles
Loss of time
Loss of vehicle use
Additional repairs

Under no circumstances shall Nelson Performance’s total liability exceed the amount paid for the specific service or product provided.

Indemnification

The customer agrees to indemnify and hold harmless Nelson Performance LLC, its owners, employees, contractors, and affiliates from any claims, liabilities, damages, losses, or legal expenses arising from:

Installation or use of performance parts
Custom vehicle tuning
Vehicle operation following modification

This includes attorney fees and legal defense costs associated with such claims.
